This agreement is in Spanish and English. In the event of any inconsistency, the Spanish version is the original language and this version in English is a translation for information purposes only. These General Terms and Conditions regulate the use of the website, "CuCuToys.es", being RESUME NEXT, S.L. the owner. RESUME NEXT, S.L., (hereinafter Resume Next) is a Spanish limited liability company with registered office at Calle Sarria, 52, 28029 Madrid, and is registered in the Madrid Mercantile Registry, Volume 32702, Folio 137, Section GNE, entry 1 with Page M-588695 and with VAT number: B8711303098.
These Conditions establish the rights and obligations of all Resume Next users in relation to the products and services we offer through our website "CuCuToys.es". These Terms are important to both you and us as they are designed to create a legally binding agreement between us, protecting your rights as a customer and our rights as a company.
The fact of placing an order on "CuCuToys.es", is equivalent to the full and complete acceptance of the prices, the description of the products for sale and the general conditions, which will be the only ones applicable to the contract thus concluded.
You agree to use the CuCuToys.es website to make legally valid inquiries or orders. You also agree to provide us with your email address, postal address and/or other contact information in a true and correct manner, being aware that we may use this information to contact you if necessary. If you do not provide us with all the information we need, we will not be able to process your order.
When placing an order through "CuCuToys.es" you guarantee that you are fully authorized to use the debit/credit card, if you choose this payment method. Only persons with the legal capacity to enter into contracts relating to the type of goods and services offered on this website can place orders on CuCuToys.es.
To place an order for the peninsula or Balearic Islands, you must follow the online purchase process until payment. If your order is destined for the Canary Islands, at the end of the purchase process and payment, the ClickCanarias platform will be used and its terms and conditions will apply.
Once the purchase process is complete, you will receive an email acknowledging receipt of your order (the "Order Confirmation").
Availability of service: The items offered through this website will only be available in mainland Spain, Canary and the Balearic Islands, Belgium, France, Germany, Holland, Italy, Luxembourg, Portugal and UK.
RESUME NEXT will do its best to satisfy all its customers in the demand for the products.
Please note that the stock of all items on offer is limited. Resume Next will make all reasonable attempts to ensure that customers are notified when stock may be low.
If we are unable to fulfill an order at the advertised price because stock is sold out or unavailable, we will let you know and you will be entitled to a reimbursement or a credit note for the full amount you have paid for such product. New stock is subject to a change in price without notice.
The delivery of the goods will be made to the address you specify in the Shipping Address field. In case you are absent at the time of delivery, the carrier will leave a note, and will try to deliver your order the next business day.
In most cases you will receive a tracking number as soon as your order is shipped.
We reserve the right to change the carrier, provided it does not cause any damage to you.
Shipping cost depends on the transportation mode chosen, weight and delivery address. We offer free shipping on orders over 19.00€
For the purposes of these Conditions, "delivery" or "delivery" shall be deemed to have taken place or to have taken place when the product(s) were "delivered" at the time of signing the receipt of the product(s) at the agreed delivery address.

We reserve the right to remove any product or content from our website at any time.
Although we will do our best to always process all orders, there may be exceptional circumstances that require us to refuse to process an order, even after we have sent the Order Confirmation. We reserve the right to do so at any time, at our sole discretion.
We shall not be liable to any third party for the removal of any product from our CuCuToys.es website (whether or not such product has been sold), removal or modification of any material or content on the website.
We promise to deliver the products in perfect condition to the delivery address you have indicated on the order form.
You can ask us to deliver the items, to another address and to another person other than the one who placed the order, provided that the delivery address is located in the same spanish province.
Note: Orders will not be delivered to PO Boxes.
The price of the articles will be the one shown on the website. The price is expressed with taxes included, as these taxes are fixed on the date of acceptance of the offer. The price must be paid in full at the time of purchase.
RESUME NEXT reserves the right to modify at any time the sale prices listed on CuCuToys.es, but the items will be invoiced at the rates in force at the time the order is registered subject to availability on that date.
For international sales, the invoice for products, maybe delivered as EU Internal Transfer of Goods regulations, meaning 0% VAT, only if the proper VAT-number will be provided by the consumer.
Due to their special tax regime, the geographical areas corresponding to the Canary Islands are considered to be extra-community territories. Therefore, purchases made by residents of these territories are exempt from VAT (all customs clearance fees and import duties are not included in the price of the item, these costs will be known accurately prior to making the payment once it has been redirected to the ClickCanarias platform.
You can easily make your payment through the ING secure payment gateway, using one of the following cards: VISA, VISA electron, MASTERCARD, MAESTRO or 4B.
During the purchase process, when you choose this option, you will be forwarded to the REDSYS payment gateway to make the payment. REDSYS and ING guarantee security and confidentiality throughout the entire process. CuCuToys will not know your credit card number or any related information. Your data will be only and exclusively in the REDSYS payment gateway, which is who processes the payment. The bank uses a secure payment gateway that uses the SSL (Secure Socket Layer) protocol, which guarantees maximum security for your data or card details.
This is the fastest method of payment. We receive confirmation of payment immediately, so we can process the order from then on.

Please note that we will not process any orders using this payment method until we have received the deposit into our account (and this time may vary between 1 and 3 days, depending on the bank of origin). In case you are not satisfied with the product(s) purchased, you already had them, you have confused in your purchase or simply do not want it, just follow the steps below within 14 calendar days of receiving the product:

Although the law stipulates a period of 14 calendar days for the return of the amounts, we try to process them in a maximum of 48 hours (working days).
If the product was paid for with a credit card, the payment will be made on the same card used for the purchase.
If you are returning an item using a gift receipt, your refund will be in the form of a merchandise credit when accompanied by the gift receipt.

Once we receive the notification, we will contact you to inform you about how to proceed and wich carrier will be used to do so. As a general rule these are the steps to follow:
You must return the product to the address indicated on the invoice you will receive by mail, providing the following information:
Please return the item in its original packaging, including all instructions, documentation and packaging that may accompany the item.
Once we receive the returned goods, we will examine the returned product and inform you by e-mail within a reasonable period of time if a return or replacement is required. The return or replacement of the item will be made as soon as possible and in any case within 30 days of the date on which we send you an email confirming that the return or replacement of the non-conforming item is appropriate.
In the event that the product(s) cannot be replaced, the amounts paid for those products that are returned, due to any tare or defect, will be refunded in full, including the shipping costs incurred to deliver the item to you and the costs you have incurred to return it to us.
Partial refunds and cancellations will give rise to partial refunds of the total amount paid for the entire order. Shipping, refund and gift packaging costs will not be refunded if the return is partial.
If the order was paid using a credit/debit card, the return will be made on the same payment method used to pay.

In shipments to the Canary Islands, returns will be made through the ClickCanarias platform and should follow their shipping and return conditions.
In accordance with Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, Resume Next is liable for any lack of conformity that may arise within two years of delivery.
In the case of lack of conformity, you must inform us within two months of becoming aware of it by sending an email to [email protected] indicating your details, the order code or the invoice number and the anomaly detected. In the event of a manufacturing defect, Resume Next will be responsible for the return costs, as well as the costs related to labor and materials.
To ensure full refund, items must be returned, in new, or like-new condition, in its original packaging and with all paperwork including manuals, assembly instructions and your in-store receipt, as well as all accessories
The instructions for the correct use and installation of the product, as well as the warranty documentation included by the manufacturers, must be read by the buyer.
The guarantee shall become void in the event of defects or damage caused by external factors, accidents, in particular electrical accidents, wear and tear, installation and use not in accordance with the Supplier's instructions.
Products modified or repaired by the customer or any other person not authorised by the supplier are also excluded from the guarantee.

In the event of a defective product, Resume Next shall proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, which shall be free of charge for the consumer.

The responsibility of Resume Next in relation to any product purchased in CuCuToys.es will be strictly limited, in any case, to the cost of the product purchased and will not be compromised by simple errors or omissions that may have taken place, when all the necessary precautions have been taken in the presentation of the products.
Resume Next cannot be held responsible for any damage, whatever its nature, whether material, non-material or physical, that may result from improper operation or use of the products marketed. The same applies to possible modifications made to products by suppliers.
Resume Next shall not be held liable by a customer or third party for indirect damages, loss of use or loss of profit caused by any means whatsoever, even if such damage, loss or loss was foreseeable by RESUME NEXT or if its eventuality had been brought to its attention.
Subject to the provisions of the preceding paragraphs, Resume Next's liability under these general terms and conditions shall not exceed an amount equal to the sums paid after the transaction giving rise to such liability, regardless of the cause or form of the action in question.
Resume Next cannot be held responsible for the non-fulfilment of the contract signed in the event of exhaustion of stocks or unavailability of the product, due to force majeure, interruption of activity or total or partial strike, in particular, of the postal services and means of transport or communications, flooding or fire.
The provisions of this clause shall not affect your statutory rights as a consumer or your right to withdraw from the contract.
In the event of a dispute, you can first contact Resume Next to reach an amicable settlement.
Applicable law requires that some of the information or communications we send you be in writing. By using the CuCuToys.es website you agree that most communications with us are electronic.
We will contact you by email.
In all legally binding communications and in the formulation of the contract we will use the official language of the Spain, Spanish. We may use English in the electronic communications if you selected English in the website as your language.
For contractual purposes, you agree to use this electronic means of communication and acknowledge that all contracts, notices, information and other communications we send you electronically comply with the legal requirements to be in writing. This condition will not affect your statutory rights.
Please use our contact form to send us any notification. In accordance with the above and unless otherwise stipulated, we may send you communications either by e-mail or to the postal address you have provided when placing an order.
Notices will be deemed to have been received and correctly made at the same time they are posted on our website, 24 hours after an email has been sent, or three days after the postmark date of any letter. To prove that the notification has been made, it will be sufficient to prove, in the case of a letter, that it had the correct address, was correctly stamped and that it was properly delivered to the post office or to a mailbox and, in the case of an e-mail, that it was sent to the e-mail address specified by the recipient.
